Important Notice
These Terms constitute a legally binding agreement. By using the Platform, you accept these Terms in full. If you are accepting on behalf of an organisation, you warrant you have authority to do so.
"Platform" means the KYW know-your-website monitoring service. "Client" means you, the subscribing business. "Merchant" means any third party whose website you register for monitoring. "Check" means one automated analysis of a Target URL. "Consortium Data" means anonymised aggregate intelligence derived from all Platform clients.
You must be at least 18 years old and have legal capacity to enter contracts. The Platform is for business use only. You must provide accurate information and maintain its accuracy. You are responsible for all activity under your account and must notify us immediately of any unauthorised access at security@kyw-platform.com.
Before registering any Merchant for monitoring, you must: (1) Hold explicit written authorisation from the Merchant permitting automated monitoring; (2) Have informed the Merchant that their website content will be collected, analysed by AI, and retained as audit records; (3) Have legal authority to conduct such monitoring (e.g. under merchant services agreements, marketplace terms, or regulatory mandate). You expressly represent and warrant that this authorisation exists for every Target URL registered. KYW accepts no responsibility for monitoring conducted without proper authorisation.
Subject to these Terms and payment of fees, KYW grants you a non-exclusive, non-transferable licence to use the Platform. Services include automated website monitoring, AI content analysis, screenshot capture, anomaly detection, domain intelligence, consortium intelligence, alerts, and API access. AI Analysis results are probabilistic — you must apply human judgment before taking consequential action based on results.
You must not: monitor websites without lawful authority; use the Platform for personal surveillance; attempt to circumvent security measures beyond the passive bypass methods provided; reverse engineer AI models; resell or sublicence the Platform without written consent; submit false blacklist reports; interfere with Consortium Data integrity. We may immediately suspend your access for breach.
Subscription fees are billed in advance. Overage charges are billed in arrears. Blocked checks (site blocked all bypass attempts) and platform-error failed checks are not billable. Fees are non-refundable except as required by law. All fees are in USD. If payment fails, we retry over 7 days before suspending your account.
By using the Platform, you grant KYW a perpetual, irrevocable licence to use anonymised, aggregated data from your monitoring for Consortium intelligence. Your individual merchant identities and configurations are never disclosed. Only aggregate statistics are shared. Consortium Data is proprietary to KYW.
KYW retains all rights in the Platform, AI models, and Consortium Data. You retain rights in your Client Content and grant KYW a limited licence to process it to provide services. Check Data (screenshots, reports) is owned by you; KYW retains a licence to store and process it.
THE PLATFORM IS PROVIDED "AS IS". KYW DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT. AI ANALYSIS IS NOT GUARANTEED TO BE ACCURATE OR COMPLETE. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
KYW's total aggregate liability shall not exceed the greater of: (A) fees paid in the three months preceding the claim; or (B) USD 1,000. KYW is not liable for indirect, consequential, punitive, or incidental damages including lost profits or data.
You shall indemnify KYW against claims arising from: your breach of these Terms; monitoring without proper authorisation; violation of applicable law; or use of Check Data to take action against any Merchant.
These Terms are governed by the laws of Malaysia. Disputes shall be submitted to good-faith negotiation, then to the Asian International Arbitration Centre (AIAC) in Kuala Lumpur under its arbitration rules.
